'' An essential part of contractual relations is determining the correct entity that will take part in a transaction. As agents are required to be able to complete a contract for the sale of land or sale of a business, it is essential that all agents are able to understand the difference between types of entities and the reasons underlying the use of each.
By the completion of this session participants should be able to:
1. Identify the various entities that may enter into contracts for the sale of land or a business;
2. Better understand how each type of entity functions, including the reason why certain entities are used in particular transactions;
3. Identify the issues involved in the purchase of assets by a self managed superannuation fund;
4. Understand the complexity involved in the application of the agency and substitute purchaser provisions of the Duties Act 2008. ...''
