'' Despite efforts to simplify the superannuation system, the provisions relating to the payment of superannuation death benefits remain a complex area.
Where an adviser is recommending an investment into a superannuation accumulation account or a superannuation income stream, the associated estate planning considerations must be properly considered.
Key issues critical to the application of the provisions include:
difficulties arising from the interaction between superannuation law, taxation law and the fund’s trust deed;
nominating beneficiaries and selecting the most appropriate type of nomination; and
potential strategy applications and key factors to be considered.
Key Planning Issues for Super Death Benefits is designed:
provide an understanding of the importance of superannuation assets in the estate planning process;
enable advisers to advise their clients on the type of death benefit nomination which best suits their circumstances;
examine which potential beneficiaries will be considered to be a dependant for superannuation and taxation purposes;
review the relative merits of a beneficiary receiving a death benefit in the form of a lump sum or a pension, and explain the restrictions applying to the payment of death benefits in the form of a pension; and explore the advantages of using particular strategies to achieve tax effective death benefits.
