'' This course examines the connection of law with politics and society. How judges and lawyers interpret and apply the law has increasingly become a topic of public policy debate. Recent headlines reflect this trend. Examples include the standards used by Supreme Court Justices to decide cases, court decisions arising out of the War on Terrorism, Texas’ very own prison and education reform cases, and the Travis County D.A.’s decision to indict Representative Tom Delay. Moreover, the legal system itself has become an issue. For example, some critics charge that large jury awards in personal injury cases are excessive, while others respond that the judicial system favors large corporations at the expense of ordinary citizens.
The role of law in the context of these major social issues will be the focus of this course. In the process of examining these topics, the course will be organized around some core questions. How political is our legal system? What is law and what are its main functions? What are the main kinds of law? What are the limits and potential for courts as policy makers and agents of social change?
To shed light on these issues, we will turn to works from a variety of sources including law and political science. Our framework for understanding will place the law within the context of government and politics. Accordingly, analysis will proceed from the perspective of political science, with special emphasis given to studies on public policy and the politics of the legal process.
