Course Description:

'' This course is designed for those advising clients on bringing claims against insurers and for those defending claims on insurers’ behalf. The course concentrates on the wording of policies and on defences that may be raised by insurers in the light of recent Court decisions and legislative developments. It also covers new claims, which may be brought by third parties directly against insurers. There will be a case study seeking to put claims strategy and litigation tactics into practice. The following will be considered:
Interpretation of insurance wording
Insurers avoiding insurance for material misrepresentation/non-disclosure
Insurers’ defence based on breach of warranty
Insurers’ defence based on breach of condition precedent
Insurers’ reliance on exclusions/exceptions
Fraudulent claims and fraudulent devices
Claims co-operation by the insured
Third party claims
Grasping the initiative when litigating and negotiating claims
