Many UK workers with key skills benefit from the freedom and challenges of working flexibly. Up until now, the UK has enjoyed a relatively light level of regulation in the contract and temporary employment sector. As a result, end-users have found it efficient and economical to resource major UK telecoms, IT and engineering projects with contract and temporary specialists.

The total annual spend on IT and telecoms contractors is in the region of £5 billion per annum, with spend in other sectors including engineering amounting to as much as £15 billion total. A huge supplier industry has grown up over the last 10¨C20 years to service this demand.
Regulation of this area is increasing, and there is widespread concern about previously unsuspected legal risks associated with the use of temporary and contract workers. These risks arise in relation to employment rights claims by contract workers, IR35, Data Protection issues, the Temporary (Agency) Workers Directive, ownership of intellectual property rights, the regulation of material outsourcings by financial services organisations, the Conduct of Employment Agencies and Employment Businesses Regulations and immigration legislation. The Government¡¯s current consultation about extending full employment rights to all atypical workers may cause further complications.

Therefore, unsurprisingly, management of this resource is increasingly being centralised by users into procurement departments. This seminar is designed to give guidance on current best practices in the procurement of specialist contract and temporary workers, will identify which procurement strategies seem to be working in this area, will look at future trends and will explain what the legal risks really are and how to deal with them.
