'' This course explores significant legal issues in the context of state and federal environmental laws. Students read landmark decisions written by the United States Supreme Court, Federal Circuit Courts, state courts and administrative tribunals. The cases introduce and apply legal concepts such as standing to sue, due process, remedies, standard of review, Fifth Amendment takings claims, federal power and states rights. The class explores the meaning of these concepts in the field of environmental law. In the process, students study those major pieces of legislation that form the environmental protection framework for Pennsylvania and the nation, including the National Environmental Policy Act, the Clean Air Act, the Clean Water Act and Pennsylvanias Land Recycling Law. Students learn the basics of administrative rulemaking and procedure and will learn specifically how to proceed before the Environmental Protection Agency (EPA) and the Department of Environmental Resources (DER). ...''
