Course Description:
'' Deals with how the tax law treats derivative financial instruments such as options and futures contracts, swaps, (both equity and interest rate types), REMICs and other hybrid type instruments entered into with financial intermediaries either to hedge a business risk or to simply bet on future changes in the market. Issues include the timing (i.e., when is income or loss on the instrument recognized, by either mark-to-market or realization accounting), character of the income or loss as capital or ordinary, and source (foreign or domestic) of the derivative financial instruments. Tax law rules dealing with these issues include ยงยง 1234, 475, the notional principal contract regulations, and the contingent debt regulations. The law is silent as to certain instruments (e.g., prepaid forward contracts), so the course will address not only the tax rules we have but also the rules we should have, where no current rules exist. ...''
